Terms of Use

The following terms and conditions (“Terms”) govern all use of the Design Teaching Resource (DTR) website and all content published here. Our Services are offered subject to your acceptance without modification of all the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time by AIGA (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Design Teaching Resource. By accessing or using this website, you agree to become bound by the Terms of this Agreement. If you do not agree to all the Terms of this Agreement, then you may not access or use any of this site.

Uploading Projects to this website requires a DTR account. You agree to provide us with complete and accurate information when you register for an account. You will be solely responsible and liable for any activity that occurs under your username. You are responsible for keeping your password secure.

Copyright Infringement

If you create a profile on the DTR, you are fully responsible for all activities that occur under the account and any other actions taken in connection to the DTR. You must immediately notify AIGA of any unauthorized uses of your profile, your account, or any other breaches of security. AIGA will not be liable for any acts or omissions by you, including damages of any kind incurred because of such acts or omissions.

If you post a Project on the Teaching Resource you are entirely responsible for the content of, and any harm resulting from, that Content or your conduct. That is the case regardless of what form the Content takes, which includes, but is not limited to text, photo, video, or audio. By using the DTR, you represent and warrant that your Content and conduct do not violate these Terms or the Community Guidelines. If you delete Content, AIGA will use reasonable efforts to remove it from the Teaching Resource, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

As AIGA asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by the Teaching Resource violates your copyright, you are encouraged to notify the user who posted the Content. If the issue is not resolved and you believe that your work has been used on our Site in a way that constitutes copyright infringement, you should send written notification thereof, in accordance with the provisions of the Digital Millennium Copyright Act (the “Notification”), to our Designated Copyright Agent (this might be Annabelle Gould, who will register the site and serve as the copyright agent). AIGA will terminate a user’s access to and use of the website if, under appropriate circumstances, the user is determined to be a repeat infringer of the copyrights or other intellectual property rights of AIGA or others.

Intellectual Property

The Projects posted here are the intellectual property of the individual educator, the students whose work is represented and the educator’s institution. Educators must follow their individual institution’s copyright rules regarding publishing student work on this website.

The DTR site contains links to information and other websites (under “Resources”) that we think may be of interest to you. We do not endorse or sponsor any Linked Sites except for AIGA.org and educators.aiga.org, and we have no control over and are not liable or responsible for the content of Linked Sites. Remember that when you link to or share content on another website, that other website is governed by its own terms of use and privacy policy, which you should read and understand. Access to and use of any Linked Sites is solely at your own risk.

Disclaimer of Warranties

The DTR site and all Content or materials you download or obtain from the Site is accessed at your own risk, and you will be solely responsible for any damage or loss that results therefrom. To the maximum extent permitted by applicable law, the Site, including all text, graphics, logos, audio and video clips, photographs, and other content is provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE,” and the entire risk of use and performance remains with you. We do not make any representations, warranties, or conditions, express, implied, or statutory, and hereby disclaim any and all warranties with respect to the Site. In particular, we make no representation or warranty that the Site, Content, or products: (a) will meet your needs or expectations; (b) will be available or provided on an uninterrupted, timely, secure, or error-free basis; (c) will be accurate, complete, or reliable, or (d) will be free from viruses, worms, or other harmful or malicious components. Nor do we warrant that any defects or errors on the Site or Content will be corrected.

Disclaimer of Certain Damages

To the maximum extent permitted by applicable law, in no event will we be liable for any consequential, special, incidental, indirect, or punitive damages of any kind, whether foreseeable or not, arising out of or in any way connected with the Site, Content, Products, or these Terms, even if we have been advised of the possibility of such damages.

Changes

We will be updating the Teaching Resource from time to time. That means sometimes we will change the Terms of Use. If we make changes that are material, we will let you know by posting on the site. The notice will designate a reasonable period after which the new terms will take effect. If you disagree with our changes, then you should stop using the Design Teaching Resource within the designated notice period. Your continued use of the Design Teaching Resource will be subject to the new terms. However, any dispute that arise before the changes shall be governed by the Terms (including the binding individual arbitration clause) that were in place when the dispute arose.

Termination

AIGA may terminate your access to all or any part of the Teaching Resource at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your AIGA account (if you have one), you may simply discontinue using all AIGA resources. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; AIGA may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
